在英及在歐香港學生、畢業生反對《逃犯條例修訂草案(2019)》聯署聲明 A Petition of Hong Kongese Students in UK and Europe Against the Extradition Amendment Bill (2019)

2019年初,香港特區政府提出《逃犯條例修訂草案(2019)》,允許香港引渡逃犯至中國大陸,引起香港甚至國際社會嘩然。回顧歷史,英方制訂條例當年考慮到港中兩地司法差異,故移交逃犯安排明言不適用於中國大陸地區。自特區政府提出修例以外,美國及歐盟已經多次表明憂慮修訂威脅香港高度自治。美國美中經濟與安全審查委員會(USCC)於5月7日發表的研究報告指,「鑒於北京加劇侵蝕其對香港所承諾之自治與自由,法案將成為干預香港事務的有力法律工具。」修訂通過後或會違反《美國-香港政策法》多項關鍵條款,令美國政府有必要重新審視《美國-香港政策法》。然則香港現時享有的獨立關稅區地位,以至於對美國、英國及歐盟的經貿關係與文化交流將受到嚴重挑戰。歐盟成員國亦於5月24日向特區政府發出外交照會,重申對港府修訂《逃犯條例》的關注。

由是觀之,是次修訂不僅損害香港一國兩制及高度自治地位,而且直接影響英國及歐盟對港關係。港人現時在英國及歐盟的留學、工作及旅遊簽證待遇或受影響,而一眾在英及在歐香港留學生亦將首當其衝。故此,我們強烈反對修訂案。

我們要求香港特區政府馬上撤回《逃犯條例修訂草案(2019)》,以保障香港現時享有之國際特殊地位不受損害。

In early 2019 Hong Kong SAR government proposed the Extradition Amendment Bill (2019) which permits extradition of fugitive offenders to the mainland china. The bill causes an uproar in both Hong Kong and the international community. Looking back at history, British colonist was aware of the differences in jurisdiction systems between Hong Kong and the mainland China, therefore, extradition arrangements with mainland China was prohibited. According to the report by USCC published on 7th May, ‘as Beijing accelerates its encroachment on the territory’s autonomy and guaranteed freedoms, the
bill could provide it a powerful legal tool to further intrude into Hong Kong’s affairs.’ If passed, the bill may violate several key provisions of the U.S.-Hong Kong Policy. It is therefore necessary for the U.S. government to reconsider U.S.-Hong Kong Policy, which means that the current status of Hong Kong as a Separate Customs Territory and the trading and cultural exchanges among Hong Kong, USA, UK and EU countries are under threat. On 24 May, European Union countries
lodged a joint demarche to Hong Kong SAR government reiterating w to Hong Kong’s Fugitive Offenders Ordinance.

Therefore, not only will the amendment erode the One Country Two Systems and the Autonomy of Hong Kong, but also the UK-HK and EU-HK diplomatic relations. The current arrangements of studying, working and travelling visa applications for Hong Kong residents in UK and EU may be affected. Hong Kongese oversea students in UK and EU will be the first to be affected. For this reason we strongly oppose the bill.

We urge Hong Kong SAR government to withdraw the Extradition Amendment Bill (2019) immediately so as to protect the special international status that Hong Kong is currently enjoying.
